Case Background
Plaintiff Porfiria Delgado lived in San Diego. On December 15, 2022, she walked north on E. San Ysidro Boulevard near 721. The sidewalk sat level and flat. City of San Diego, County of San Diego, MTS, and State of California owned and maintained the area. The location served regular pedestrian traffic. Plaintiff filed government claims in March 2023. City, County, and MTS issued written rejections. State did not respond. Plaintiff then filed this action in the Court.
Cause
Crews removed a traffic sign at the Subject Location. However, they left a cut metal pole nub protruding from the sidewalk. No warning marked the remnant. The exposed metal created a foreseeable tripping hazard for pedestrians. Defendants allegedly designed, maintained, and controlled the area. They failed to fully remove the pole or flag the danger. Consequently, Plaintiff’s foot struck the nub. She tripped, fell, and suffered injury. The event triggered this dispute.
Injury
Plaintiff reported internal and external injuries. She experienced shock, pain, discomfort, and anxiety. She required medical assessment and treatment.
