Case Background
Plaintiff Jeffrey S. Dolphin lived in San Diego. On March 14, 2021, he rode his 2002 Harley-Davidson eastbound on Clairemont Mesa Boulevard. The Subject Location lay in the North Clairemont neighborhood. City of San Diego and County of San Diego owned and controlled this roadway. The area served businesses and residences and saw heavy traffic. Plaintiff complied with California’s government-claim requirements before suit. City received his claim on August 16, 2021. County rejected his claim on August 17, 2021. Plaintiff then filed this action in the Superior Court.
Cause
The roadway at the Subject Location deteriorated severely. It contained numerous large potholes and “crocodile cracking.” A raised patch created a bump, then a drop where the patch ended. No warning signs alerted motorists. Defendants’ prior patching created uneven surfaces. Moreover, they failed to inspect, maintain, or repair the defects. Consequently, Plaintiff struck these conditions, lost control, and fell. His head slammed onto the pavement. The fall triggered the present dispute.
Injury
Emergency responders transported Plaintiff to Scripps. He arrived with a Glasgow Coma Score of 13. CT scans showed a frontal lobe contusion and bilateral subarachnoid hemorrha
