Case Background
On November 15, 2021, Plaintiff Francisco Hernandez Tello walked along a public sidewalk at 11113 San Fernando Road, Los Angeles. Defendant City of Los Angeles owned or controlled the sidewalk. Plaintiff alleged the walkway was uneven and in disrepair. A protruding metal pole base stuck out from the ground. The location served regular pedestrian traffic. Plaintiff claimed the area was not code compliant and remained poorly maintained.
Cause
Defendants allegedly created or allowed a dangerous condition on the sidewalk. The surface was cracked, uneven, and broken. The pole base projected above the walking path. Plaintiff asserted the City ignored prior complaints and warning signs. He argued the City knew or should have known of the hazard. It failed to repair, barricade, or warn pedestrians. Then Plaintiff tripped on the protrusion and fell. Consequently, he blamed negligent ownership, operation, design, supervision, construction, and maintenance. He also alleged inadequate inspection and lack of reasonable care.
