Facts of the Case

The Plaintiff, Kimberley M. Agee, was operating her car when she was rear-ended by the Defendant, Amber Edwards in Rockledge, Brevard County, Florida. Agee suffered bodily injury including a permanent injury and sued Edwards and her insurance company, State Farm Mutual demanding damages. According to a post by The Morgan Connection on LinkedIn, she turned down a pre-trial settlement offer of $100,000.

The Expert Witnesses

Apart from the treating physicians, the Plaintiff retained Dr. Andrew Boltuch to prepare a Life Care Plan and to testify on causation and damages, amongst others. The Plaintiff also retained Dr. Jose Pizarro, M.D., a board certified radiologist and neuroradiologist to testify regarding the radiology studies and issue opinions on causation. He was retained because one of the treating physicians, Dr. David Feldman, had passed away.

The Defendant, State Farm, retained Dr. Ira Fox, M.D., a board certified interventional pain management physician and Dr. Calvin Barnes, M.D., a board certified radiologist. Dr. Barnes was retained to testify to the injury claims and damages allegedly suffered as a result of the accident.

The Trial and the Verdict

The Plaintiff was present in the Court on the day of the trial. The Plaintiff’s attorney called Dr. Pizarro to testify. The Defendants called Dr. Kenneth Hawthorne to testify. By 6.52pm, the jury had reached its verdict.
